GENERAL CONDITIONS
Article 1 – Contract
This seasonal rental contract is exclusively reserved for the rental and accommodation of the Villa des Templiers, located at Impasse des Templiers (La Ville es Nonais 35). Under no circumstances shall we be held responsible for the use of this contract by third parties or for purposes other than tourism.
Article 2 – Duration of Stay
The tenant signing this contract, which is concluded for a fixed duration, may not, under any circumstances, claim any right to remain in the premises after the stay.
Article 3 – Conclusion of the Contract
The reservation becomes effective once the tenant has sent the owner a deposit of 30% of the total rental amount and/or a signed copy of the rental contract. The rental agreement between the parties to this contract may not, under any circumstances, be transferred, even partially, to third parties, whether individuals or legal entities, without the owner's written consent. Any violation of this clause may result in the immediate termination of the rental at the tenant's fault, with the rental amount remaining fully acquired by the owner.
Article 4 – Documentation
The names, surnames, and ages of each tenant will be requested before arrival.
Article 5 – Rates
The rates listed on our information sheets include all taxes, excluding the tourist tax. Our prices are calculated based on the applicable VAT rates and may be subject to change in case of modifications to these rates. If the balance is not paid on the day of arrival, management reserves the right to cancel the stay. A collection fee of €40 will be charged.
Article 6 – Taxes and Contributions
The amount of the tourist tax and any other applicable taxes related to your accommodation are available upon request.
Article 7 – Capacity
The number of persons indicated in our rates and brochures corresponds to the maximum authorized occupancy, considering the available equipment. This limit cannot be exceeded for safety and insurance reasons. Management reserves the right to refuse access to the accommodation if the number of persons exceeds the authorized maximum occupancy.
Article 8 – Declaration of Any Event (Birthday or Other Private Events)
It is mandatory to declare any event (birthdays or others) before your arrival, specifying the number of people present. You must also respect the site's safety and tranquility rules (lowering music volume from midnight) and declare the event to your own insurance.
Article 9 – Modification of Stay
Any requested modification of the stay regarding dates, location, duration, number of persons, or family composition must be validated by our services. Additional charges may apply. In the event of external circumstances beyond our control, we may be required to modify or cancel your stay. In such cases, we will offer, subject to availability, an equivalent stay on different dates. If this offer is unsatisfactory, all amounts paid will be refunded. No additional compensation may be claimed.
Article 10 – No Right of Withdrawal
For reservations made by mail, telephone, or online, the tenant does not have a right of withdrawal, in accordance with Article L121-21-8 of the Consumer Code regarding accommodation services provided on a specific date or for a specific period.
Article 11 – Cancellation by the Tenant
All cancellations must be notified to the owner by registered letter.
Cancellation before arrival: The deposit and booking fees remain acquired by the owner for any stay canceled more than 30 days before arrival.
Cancellation within 30 days before arrival, interruption, or non-use of the stay for any reason: The full amount of the reserved stay is due and remains acquired by SCI des Templiers.
No refunds are granted for interrupted stays. If the stay is shortened, the rental price remains due to the owner.
No-show within 24 hours after the arrival date stated in the contract: The contract is considered null and void, and the owner may reallocate the accommodation. The deposit remains acquired, and the balance of the rental will still be due.
Article 12 – Cancellation by the Owner
The owner will refund the tenant the full amount paid.
Article 13 – Arrival
The tenant must arrive on the specified date and time mentioned in this contract. In case of late or delayed arrival, the tenant must inform the owner.
Article 14 – Payment of the Balance
The rental balance must be paid upon entry into the premises.
Article 15 – Cleaning
The tenant is responsible for cleaning the premises during the rental period and before departure. Any additional cleaning fees will be charged based on the service provider’s rates.
Article 16 – Security Deposit
Upon arrival, the tenant must provide a security deposit in the amount specified on the front of this contract. The deposit must be made by check payable to SCI des Templiers.
Article 17 – Use of the Premises
The tenant must ensure the peaceful use of the rental property and use it in accordance with its intended purpose.
Article 18 – Capacity
This contract is established for the maximum capacity specified in the rental agreement. If the number of tenants exceeds the accommodation capacity, the owner may refuse additional persons. Any modification or termination of the contract due to this will be considered initiated by the tenant.
Article 19 – Pets
For hygiene and safety reasons, pets are not allowed.
Article 20 – Insurance
The tenant is responsible for all damages caused by their actions. They are required to have a holiday rental insurance policy covering these risks.
Article 21 – Valuables
It is recommended not to leave valuables in the Villa.
Article 22 – Smoking
Smoking is strictly prohibited inside the premises.
